BUSTED....

Post by stu9000 »

Now Im really missing my VTR baby.
Shes been in the shop for a month now.
Turns out, while i was on the loan bike, a GSXR 750, a camera caught me doing 45 in a 30 zone. Yes yes, I know. Silly. Annoyed.
But that bike really span up like nothing id ever ridden before.

So,,, asking for help.

Got a notice of intended prosecution.
No picture included but Ive sent off a letter asking for the photographic evidence.

They want me to reply saying i was the rider of the bike.
(which I was).

BUT wasnt there something a couple of years ago where you could not be forced to answer that question?

Any other tricks or advice welcome.

Also, assuming I do admit it.
What can I expect?
Got a clean licence at the mo.

Any advice or links to posts most welcome.

Except all that stuff from VTR girl about wonderbras and nurses outfits.

I think you can expect your licence not to be clean anymore

For 45 in a 30 you'll probably end up with 3 points and £60 fine - not too bad.

Legally you have to declare who was riding at the time. The loophole a year ago was that you didn't have to sign it. If it wasn't signed then it couldn't be used as evidence in court so people got off.

Don't know if this has changed now???

I'm afraid that doesn't work so well with the camera fines anyway...
I did once get an ex off a 6 point fine, though. And this may help you if you're good with words (if not, pm me & I'll give you a hand...). Providing you're not too young a whipper snapper, it's well worth a shot. I penned an absolute masterpiece for this fella, basically claiming "I've been pretty good for so long, give me a chance..." and it worked. He was interstate at the time & it was a long weekend (double points & fines over here).

You have two very strong points going in your favour: you weren't on your normal bike and you have a clean record thus far. If you admit it was you & basically cry I've learnt my lesson & will be good from now on, but do it believably, then you might just be let off.

And btw, I don't need a wonderbra...

 Not at all, Kev. They've served me well over the years & show no signs of letting me down just yet.

Stu start praying you get a judge in a good mood.
45 in a 30 is not good news nowdays it's worse than 95 in a 70.
The way they might look at it is:- were you in a built up area?
Could there of been small kids about? Is there a school nearby?
Or were you in a out of town area?
Mate if you were in a built up area you might get well and truely screwed.
Maybe 6 points and a couple hundred quid fine if not worse.
Better to burn out than just fade away!

If they are offering 3 +60 take it. Don,t go to court, it isnt a judge its a magistrate. They MIGHT get stroppy.
No harm done, just pay up and learn (where the scameras are :D )

Thanks folks.
Not near a school or kids or pedestrians etc.
VTR girl, good idea, I might try to compose a poetic masterpiece.
Ill pm it to you for feedback once I get back from Ireland.

Hopefully itll be 3 points. If its 6 and a 200 quid fine Ill be PISSED off.
However I agree that going to court is always a risk. Some ol judge that thinks bikers are evil holding your licence in his hands is not a good idea.

One good bit of news.
I get my shiny red vroom vroom baby back just in time to go on holiday.
NOw,,, mustnt drop it and scratch all that shiny newly sprayed tank and faring.

I'll have you know I got picked for jury duty last week so I'm well up on legal matters. I was watching the advocates (barristers to the southern lot) in action so I'll be able to defend you no problem. I'll get you off and have them apologising to you for wasting your time :D

No worries Stu. I spent 10 years as a legal secretary before I went into nursing, so the lingo is pretty much second nature (sad, I know...). Am also a Justice of the Peace. I reckon your clean record so far is your best defence. Just have to wait & see.
