RTA Thursday morning

So I was involved in a head on smash Thursday morning. I was filtering down grid lock traffic (10-12mph) and a guy flashed a women out. Any way she come out at some speed and hit me head on. I bounced off the car window and landed back on my feet again. Bad times. The bike is far worse then me!

Insurance are now sorting this out but I feel like it's not going to play well as I was filtering

Great I'll have a read about it later. Am talking with sorry mate.com who are hinting 50/50 well am not happy with that and told them also.

Lucky I've only got small cut and am not in to This claiming for every thing!
I want my bike fixed and helmet replaced that's all!

If the conditions were right and using that info in that link it'll be 100% the other drivers fault

Road was dry and sun was out. My headlight was on and your can't not hear a harley coming

The highway code states that...''The flashing of headlights means only one thing...Warning I am here !'' It is a warning & not a come on or a thank you.

Take the dozy cow to court & sue her pants off. It is her responsibility to carry out the manoeuvre in a safe manor with the correct observations & WITHOUT causing any other roar user to Slow down, Swerve, stop or in this case crash.

I've been told I should of seen the exit where the car was :/ trouble was am so low to the ground I could not see it and she then swinger out like lighting

I don't know if this helps, but a few years ago my mate was pulling off his driveway onto a main road and was flashed out by another driver, an impatient driver behind the car that flashed decided to overtake and hit my mate who was pulling out of his drive.

The insurance company found my mate at fault as he pulled onto a main road even though the overtaking car was impatient.

So to summarise you should have a cast iron case fella :thumbup:

My mate was a tw@ for pulling out without checking it was safe to do so

The bottom line on this is that when you join a road from any road that has give way lines, you are joining a major road from a minor road.

The traffic on the major road has priority.

It is up to the vehicle joining the major road to take all precautions to do so safely.

With any manoeuvre it is up to the person doing it to take other road users into consideration before completing said manoeuvre.

H/C ''You must not make anyone slow down,swerve or stop...''

In the H/C any rule which contains the phrase ''YOU MUST'' or ''YOU MUST NOT'' is a law not a just guide, it will always be in bold & in red with a reference to the appropriate legislation, normally the Road Traffic Act.

Glad you not badly injured. They can't say you was speeding on that bike. That car is mashed up. 8O

Car looks worse then what it is. The air bags never went off on her! Lucky!

It's a shitter allright. The main thing is that you where not severely injured or worse. What would it have been like if you didn't bounce of the screen and went through it :eek2 You where very lucky so count your blessings. Lets hope the insurance are fair about things. Shame about the bike, I quite like the look of it. A Harley version of Brutus. Was plod called to the scene?
